A hearing in Manitoba on Tuesday will decide whether Dynacare laboratory workers are classified as essential, after the Manitoba Labour Board invoked provincial legislation to require their return to work during a strike.
The union representing the workers argues that the law allowing the board to label striking employees as essential should not be employed to stop the strike and compel workers back, and is challenging its use.
Manitoba law gives the Labour Board authority to deem striking workers essential and order them to resume duties, a provision the union disputes in this case.
